Brief Description:

We are delighted to announce that Aspbury Planning working with Tim Willis of Shoosmiths and led by Kings Chambers Giles Cannock KC, have secured Outline Planning Permission for two houses on a Green Belt site at Rayleigh, Essex on appeal.

In a complex case involving a simultaneous Enforcement Appeal, the LPA, Rochford DC, having conceded that the lawful use of the Site was for unregulated open storage (UCO Class B8), the Inspector determined that, given this ‘fallback position’, permission for two houses was likely to have no greater impact on the openness of the GB and lower impact on the amenities of neighbours and amounted to ‘very special circumstances’, allowing the Appeal and granting outline permission.
